Two types of matter

The process differs for an executive and for a specialist sent to a project.

Documents for the head of a Russian company with Chinese participation, or of an accredited branch or representative office, are arranged together with the appointment decision. The following are determined: the documents needed to work in the position, the sequence of the appointment and the permit procedures, the company's obligations as employer and the procedure for a head who is not permanently in Russia.

Technical managers, engineers and other key specialists are sent to launch production and to carry out commissioning, quality control and technology transfer. The following are determined: the immigration status according to the duration of the work and the travel schedule, how the relationship with the Russian company is documented and the allocation of responsibilities between the head office and the Russian company.

China-specific considerations

  • Documents executed in ChinaDocuments on education, qualifications and experience and the company's constituent documents are apostilled and translated. The list of these documents is determined at the outset and included in the overall schedule.

This depends on the position, the nature of the functions, the length of stay in Russia and the employer. The statuses differ in their requirements for the company and the employee, the validity periods of documents and the consequences for family members; the suitable one is determined once the employee's role and schedule have been clarified.

The timeframe is made up of preparing documents in China, the invitation and visa, permits and the steps after entry, and some steps do not begin until the previous ones are completed. Preparation starts with a list of the documents to be provided by the employee and the head office, and the schedule is tied to the date on which work in Russia begins.

The immigration status and the permitted activity are linked. A document that does not match the actual nature of the work has consequences for the company and the employee, and the category is chosen according to what the employee will be doing in Russia.

The company acts as the employer or host party: it prepares documents for the invitation and permit procedures, formalizes the employment relationship and files notifications within the prescribed time limits. Most violations relate to missed notification deadlines, and a list of obligations with deadlines is provided to the company.

The employee's steps regarding the documents relating to the stay in Russia are also determined, so that ending the work does not restrict subsequent travel.

An hourly rate, a fixed fee or a combined model is used; in some cases part of the fee depends on the outcome achieved. The fee is determined by the time actually spent, the complexity of the matter and the overall timeframe of the project, and is agreed before work begins.
